1. RENTAL AGREEMENT & LIABILITY WAIVER

This Rental Agreement and Liability Waiver (“Agreement”) is entered into between Mr. Bikes Rental & Scooter (“Company”) and the undersigned renter (“Renter”). By signing this Agreement, Renter acknowledges reading, understanding, and agreeing to all terms and conditions set forth herein.

2. ASSUMPTION OF RISK

Renter acknowledges that cycling and use of rental equipment involves inherent risks, including but not limited to: falls, collisions, equipment failure, road hazards, and interactions with motor vehicles and pedestrians. Renter voluntarily assumes all such risks associated with the use of rental equipment.

3. RELEASE OF LIABILITY

To the fullest extent permitted by law, Renter hereby releases, waives, discharges, and covenants not to sue Mr. Bikes Rental & Scooter, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising from personal injury, death, or property damage in connection with the use of rental equipment.

4. EQUIPMENT CONDITION & DAMAGE POLICY

Renter accepts the rental equipment in good working condition and agrees to return it in the same condition. Renter is financially responsible for any damage, theft, or loss of rental equipment occurring during the rental period, beyond normal wear and tear. Damage costs will be assessed at fair market repair/replacement value.

• Minor damage (scratches, flat tires): $20–$60
• Major mechanical damage: $60–$300
• Loss or theft of bike: full replacement cost (up to $800 for Trek bikes)
• Loss of lock: $25 | Loss of helmet: $40

5. SAFETY RULES & OBLIGATIONS

Renter agrees to comply with all applicable traffic laws and regulations. Renter agrees to:

• Wear the provided helmet at all times while riding
• Use the provided lock whenever the bike is left unattended
• Not ride under the influence of alcohol or drugs
• Not allow any other person to use the rental equipment
• Not perform stunts, off-road riding, or dangerous maneuvers
• Report any mechanical issues or accidents to staff immediately
• Return the equipment by the agreed return time

6. HELMET & LOCK POLICY

A quality helmet and bike lock are included with every rental at no extra charge. Use of the helmet is strongly recommended and required by our insurance policy. Renter accepts full responsibility for the helmet and lock during the rental period.

7. LATE RETURN POLICY

Equipment must be returned by the agreed return time. Late returns will be charged at the hourly rate applicable to the renter’s bike type, pro-rated to the nearest hour. Renter agrees to contact Mr. Bikes Rental immediately if they anticipate being late.

8. DEPOSIT & PAYMENT

A valid credit card or government-issued ID may be held as a deposit at the Company’s discretion. Payment is due in full at the time of pick-up unless otherwise agreed in writing. Prices are as listed on our current rate card and website.

9. PHOTO ID REQUIREMENT

A valid government-issued photo ID (passport, driver’s license, or national ID card) is required at the time of pick-up. A copy may be retained for the duration of the rental period in accordance with our privacy policy.

10. MEDICAL FITNESS

Renter affirms that they are physically fit and have no medical conditions that would impair their ability to safely operate a bicycle. Renter acknowledges that the Company is not responsible for any medical emergencies arising during the rental period.

11. MINORS

Renters under the age of 18 must have a parent or legal guardian sign this waiver on their behalf. The signing guardian assumes full responsibility for the minor’s safety and compliance with this Agreement.

12. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Florida. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Miami-Dade County, Florida.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties. By signing below, Renter acknowledges having read, understood, and agreed to all terms and conditions.
